Terms and Conditions

These general terms and conditions govern the contractual relationship between Boutique Chrétienne® and the customer and the conditions applicable to any purchase made through the online store Boutique Chrétienne®. The customer declares having read these general terms and conditions of sale. Placing an order on the Boutique Chrétienne® website implies the customer's full and unconditional acceptance of these general terms and conditions of sale. These general terms and conditions of sale shall prevail over any other general or specific conditions not expressly approved by Boutique Chrétienne®. Boutique Chrétienne® reserves the right to modify its general terms and conditions of sale at any time. In this case, the changes will apply from the date they are posted online. Each order placed on the Site is governed by the general conditions applicable at the date of the order.

 -----

SECTION 1 - ONLINE STORE PURCHASE CONDITIONS

The customer declares to be legally capable of entering into a contract and to be over 18 years old.
Placing an order by minors implies that they have previously obtained the consent of their legal representatives.

The customer is prohibited from purchasing products on the site with the intent to resell them.
Boutique Chrétienne® reserves the right to refuse an order if the quantities are manifestly unusual for personal use.
You may not use our products for illegal or unauthorized purposes, and you may not, in using the service, violate the laws of your jurisdiction (including, but not limited to, copyright laws).
You must not spread viruses or destructive code.
A breach of contract or violation of any of the terms will result in immediate termination of your services.

SECTION 2 - GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (including credit card information) may be transferred unencrypted and involves (a) transmissions over various networks; and (b) changes to conform and adapt to technical connection requirements of networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any part of the Service, use of the Service, access to the Service, or any contact on the website through which the service is provided without our express written permission.
The headings used in this agreement are included solely for convenience and do not limit or affect these terms.

SECTION 3 - ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION

Products are described and reproduced by Boutique Chrétienne® with the greatest possible accuracy.
However, Boutique Chrétienne® draws the customer's attention to the fact that photographs cannot guarantee a perfect similarity with the product offered for sale, especially regarding colors.
Differences may result from the color quality of the photographs, the difficulty of displaying the texture rendering on the screen, or, without being exhaustive, technical adaptation. These differences cannot be interpreted as defects of conformity and will not lead to the cancellation of the sale.
In case of obvious error or insignificant omission between the product characteristics and its representation and/or description, Boutique Chrétienne® cannot be held liable.
The product offers and prices shown on the site are valid as long as they appear on the site, within the limits of available stock.
In case of unavailability of a product, Boutique Chrétienne® commits to inform the customer as soon as possible by email or phone and to indicate, if applicable, the estimated waiting time for the delivery of the product.
The customer may confirm their order or request the return of the product.
Preparation and delivery fees will be refunded to the customer if we confirm the refund of the entire order.
Preparation and delivery fees will remain the responsibility of the customer if they confirm the delivery of one or more available products that are part of the same order.

SECTION 4 - SERVICE AND PRICE CHANGES

The prices of products offered for sale on the Boutique Chrétienne® site are expressed in euros, including French VAT, and are valid only on the site.
Preparation and delivery fees are additional and borne by the customer, unless otherwise stated on the site. See the Delivery section.

Boutique Chrétienne® reserves the right to modify the price of its products at any time and without prior notice to the customer, notably in case of obvious error (typographical or printing) or change in the VAT rate.
The products ordered are invoiced to the customer based on the price in effect on the site at the time the order is validated by the customer.

SECTION 5 - ORDER

5.1 Creating a Boutique Chrétienne® account

Creating a Boutique Chrétienne® account is not mandatory to make a purchase on the Boutique Chrétienne® site

5.2 Discount code

The customer who has a discount code is invited to enter it during the payment step.

5.3 Order placement step

All stages of the sale are clearly identified on the site in accordance with the provisions of Article 1369-1 of the Civil Code. In application of these provisions, the customer has the possibility to verify the details of their order and its total price and to correct any errors before definitively validating their order.

The order is only definitively registered after the customer validates their payment agreement and the bank accepts the transaction. The customer's order summary is available in a printable version.

Upon recording their order, the customer receives a confirmation email containing the essential elements of their order, including the order number, the list of products ordered, and the price details.

All data provided by the customer during the ordering process and the recorded confirmation of this order serve as proof of the transaction.

Boutique Chrétienne® reserves the right to refuse any order from a customer with whom there is a dispute regarding payment of a previous order until such dispute is resolved.

SECTION 6 - ACCURACY OF COMPETENCE AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place in this store. We may, at our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we modify or cancel an order, we may attempt to notify you by contacting the email address and/or billing address/phone number provided at the time of the order. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by resellers or distributors.

You agree to provide current, complete, and accurate purchase and account information for all purchases made with us. You agree to promptly update your account and other information, including your email address, credit card numbers, and expiration dates, so that we can complete your transactions and contact you as needed.

For more details, please see our return policy.

You acknowledge and agree that we provide access to these tools "as is" and "as available" without any warranty, representation, or condition of any kind and without any endorsement. We assume no liability arising from or related to your use of optional third-party tools.
Any use by you of the optional tools offered on the site is entirely at your own risk and you must ensure that you are familiar with and have approved the terms on which the tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new services and/or features on the site (including the release of new tools and resources). These new features and/or services must also be subject to these terms of use.

If, at our request, you send certain specific submissions (for example contests) or, without request, you send us ideas, suggestions, proposals, plans, or other creative elements, online, by email, by postal mail, or otherwise (Collectively, "comments"), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate, and otherwise use in any media all comments you transmit to us. We are not obligated (1) to keep comments confidential; (2) to pay compensation for any comment; or (3) to respond to a comment.
We may, but have no obligation to, monitor, modify, or remove content that we consider to be illegal, offensive, threatening, defamatory, pornographic, obscene, or otherwise objectionable or that violates a party's intellectual property or these Terms of Use.
You agree that your comments do not violate any third party rights, including copyright, trademark, privacy, personality, or any other personal or proprietary right. You also agree that your comments do not contain defamatory or otherwise illegal, abusive, or obscene material, or computer viruses or other malware that could in any way affect the operation of the Service or any related website. You may not use a false email address, pretend to be someone other than yourself, or mislead us or third parties as to the origin of any comment. You are solely responsible for the comments you make and their accuracy. We assume no responsibility for comments posted by you or by a third party.

In addition to other prohibitions set forth in the Terms of Use, you are prohibited from using the site or its content: (A) for illegal purposes; (B) to ask others to perform or participate in illegal acts; (C) to violate any local, federal, provincial, or state regulations, rules, laws, or ordinances; (D) to infringe or violate our intellectual property rights or the intellectual property rights of others; (E) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (F) to submit false or misleading information; (G) to upload or transmit viruses or any other type of malicious code that will or could be used in any way that would affect the functionality or operation of the Service or any website, other websites, or related Internet; (H) to collect or track the personal information of others; (I) spam, phishing, pharm, pretext, spider, crawl, or scrape; (J) any action with an obscene or immoral purpose; (K) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violation of the terms cited above.

SECTION 13 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee that your use of our service will be uninterrupted, timely, secure, or error-free.
We do not guarantee that the results obtained from using the service will be accurate or reliable.
You agree that from time to time, we may suspend the service for indefinite periods or cancel the service at any time, without notice.
You expressly agree that your use or inability to use the service is at your own risk. The service and all products and services provided to you through the service are (unless we expressly state otherwise) provided "as is" and "as available" for your use, without any representations, warranties or conditions of any kind, express or implied, including all implied warranties or conditions of merchantability, fitness for a particular purpose, durability, title and non-infringement.
In no event shall Boutique Chrétienne®, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable (A) for any injury, loss, claim or any direct, indirect, incidental, punitive, special or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs or any similar damages, whether based in contract, tort (including negligence), (B) strict liability or otherwise arising from your use of any of the services or any product purchased through the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, errors or omissions in any content or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service. Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

SECTION 14 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless Boutique Chrétienne® and our parent companies, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand, including attorney fees, made by any third party due to or arising out of your violation of these Terms of Use or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

SECTION 15 - SEVERABILITY

In the event that any provision of these Terms of Use is found to be illegal, void, or unenforceable, that provision shall nevertheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable part shall be severed from these Terms of Use Service, this determination shall not affect the validity and enforceability of any remaining provisions.

SECTION 16 - TERMINATION

The obligations and responsibilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Use are effective unless terminated by you or us. You may terminate these Terms of Use at any time by informing us that you no longer wish to use our Services, or when you cease using our site.
If, in our sole judgment, you fail or we suspect that you have not complied with a term or provision of these Terms of Use, we may also terminate this agreement at any time without notice and you will remain liable for all amounts due, including the termination date; and/or may therefore refuse you access to our Services (or any part thereof).

SECTION 17 - ENTIRE AGREEMENT

A failure by our services to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision.
These terms of service and the policies or operating rules published by Boutique Chrétienne® on this site or in relation to the Service constitute an agreement between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, earlier versions of the Terms of Use).
Any ambiguity in the interpretation of these terms of service shall not be construed against the drafting party.

SECTION 18 - APPLICABLE LAW
